Paper 7/2021: “The concept of ecological transition: right or paradigm?”

Prof. Álvaro Jarillo analyzes the concept of ecological transition, its dimensions and its possible conceptualization as a paradigm or as a right. In this analysis, the evolution of the concept from other previous notions such as sustainable development is studied and the role of the individual in that process is examined. Similarly, it explores the legal force of the concept, as well as the legal assets protected in this transition. Within this framework, particular attention will be paid to its use by the European Union, as well as to other issues that affect the role of States and international organizations in the progressive development of the ecological transition. 

Paper 3/2021: “The developments of the Paris Agreements in the European foreign agenda”

Prof. Rosa Giles discusses the implementation of the Paris Agreement by the European Union. In particular, the regulatory activity in the internal sphere, which go hand in hand with the an intense foreign diplomatic and negotiating activity to coordinate aspects not included in the Paris Agreement and which require coordinated action at the international level.  

Paper 1/2021 “Some questions on the prohibition of reservations and other unilateral declarations in the Paris Agreement”

Prof. Nuria Pastor Palomar analyzes in this document the prohibition of reserves that is included in the instruments related to climate change. This conventional technique is not suitable for treaties seeking to protect community interests, with normative obligations and a universal vocation. The formulation by the Parties of other unilateral declarations, at the time of signing or expressing their consent to be bound by the Paris Agreement, refers to some specific aspects of this type of treaty, which have resorted to other flexibility mechanisms, other than those reservations, more suitable for this area.
